PURPOSE
As directed by the City Council, city staff has prepared options for a development reporting mechanism along with enforcement tools.

BACKGROUND
At the regular Council meeting held on June 4, 2024, the agenda included item 9.C Development Review Discussion. A motion was made by a Council member to direct staff to create a "reporting mechanism and enforcement tool to force compliance with all original development agreements before staff is allowed to review final plat for build-out" and to bring the item back to the July 2nd regular meeting. The motion was later amended to remove "final plat" and bring the item back to the July 9th Study Session. The item was thereafter moved to the August 13th study session to ensure all City Council members could attend the meeting.

OPTIONS FOR CITY COUNCIL CONSIDERATION
City staff has developed several suggested changes in an effort to create a reporting mechanism and enforcement tool as it relates to developments. These include the following:
1.) Amend the Land Use and Development Code (LUDC) to outline the type of violations that may be subject to enforcement and penalties.
2.) Amend the LUDC to have the City Council "approve" a Subdivision Plan, instead of "accepting the public improvements."
3.) Quarterly report on any plat amendments, final plats, or development agreements that have been administratively approved by staff.
4.) Require the property owner or applicant to attend all public hearings or the hearing will be automatically continued to a date certain.

Please refer to the PowerPoint for additional information, particularly regarding Option 1.
