PURPOSE

This proposed ordinance will amend the text of Sections 30, 40, and 60 of Article 2-4 of the Brighton Municipal Code regarding City Council Meetings. The proposed changes to the Code as well as changes to the City Council Rules of Procedure Governing Meetings (Rules) were presented to the Council at a recent Study Session.

 

In the event that Council approves the introduction of this ordinance, a resolution with corresponding changes to the Rules will be presented at the same future Council meeting as final consideration of this item. 

 

SUMMARY OF PROPOSED CHANGES

Eliminating the mechanism to go into an Executive Session from a Study Session, so as to eliminate a questionable legal practice. (Code and Rule change)

 

Automatically extend a Regular Meeting past 11:00 p.m. when the Council is in an Executive Session. (Code and Rule change)

 

Allow the Council to set the day and time for a continued Regular Meeting.  (Code and Rule change)

 

Adding flexibility to allow scheduling a Study Session on a day other than the second or fourth Tuesday of each month. (Code and Rule change)

 

Recognizing that a Regular Meeting that is moved to a day other than the first or third Tuesday is still a Regular Meeting for all purposes, rather than becoming Special Meeting. (Code and Rule change)

 

Formally recognizing the public’s ability to comment on items that are on the agenda but not subject to a public hearing. (Rule Change)

 

Updating the holidays to those currently observed by the City of Brighton. (Rule Change)

 

Correcting a citation to the correct resolution number for use of electronic devices.  (Rule Change)

 

FINANCIAL IMPACT

There is no financial impact associated with this item.

 

STAFF RECOMMENDATION

The City Attorney recommends approval of this amendment to City Code.
