INTRODUCTION / PURPOSE

The Second Amendment to the Brighton Crossing Filing No. 7 Development Agreement (the “Second Amendment”) impacts an approximately 20.905-acre property (the “Property”), generally located to the north of East Bridge Street, west of Mt. Bierstadt Street, east of Wooten Avenue and south of the intersection of Singletree Lane and Bowie Drive, situated within the Brighton Crossings Development. Brookfield Residential LLC is the applicant (the “Applicant”) and Property owner (the “Owner”). The Applicant requests to amend the Brighton Crossing Filing No. 7 Development Agreement (the “Agreement”) in order to add a new phase of public improvements.

 

BACKGROUND / PROCESSES

The Property was platted in 2020 under the Brighton Crossing Filing No. 7 Final Plat and incorporated into the associated Agreement. As the original Agreement was approved by City Council, any amendments shall be reviewed by City Council with a resolution to approve or deny the request. City Council approved the First Amendment to the Brighton Crossing Filing No. 7 Development Agreement (the “First Amendment”) in 2023 to incorporate additional public improvements associated with two new phases of development.

STAFF ANALYSIS

The Second Amendment details the public improvements outlined in the approved subdivision plan that was accepted by City Council on March 4, 2025. The Second Amendment does not alter the original intent of the Agreement or First Amendment, and any proposed changes are only to allow for additional public improvements to accommodate 126 single-family residential lots. This proposal maintains the vision for this area to develop as low density in compliance with the Comprehensive Plan.

 

The Second Amendment proposes:

 

1.                     Additional Phase. The proposal includes the addition of one new phase. As outlined in the Brighton Crossing Filing No. 7, Second Amendment Final Plat:

 

a.                     Phase X will include the design and construction of two new access points, one along Singletree Lane and one along Mt. Bierstadt Street. The Developer shall design and construct all roadways and sidewalk connections in Phase X, as well as and including, without limitation, the sidewalk connections in Tracts A, B, C, D, P and W in accordance with the City-approved Construction Plans.

 

2.                     Dedication of Right-of-Way. The Developer shall dedicate all roadways indicated as public rights-of-way in the Brighton Crossing Filing No. 7, Second Amendment Final Plat. The Developer, at its sole cost and expense, shall construct the improvements to all outlined public rights of way as shown in the City-approved Construction Plans.

 

3.                     Estimated Construction Costs. The estimated cost of construction shall be amended to include the additional phase. These documents are only provided as an estimate and will be reviewed again at the time of Development Permit review and when financial guarantees are necessary.

 

Development Review Committee:

The Development Review Committee (DRC) has participated in several formal rounds of review as well as topic-specific meetings for this project. The Development Review Committee recommends approval of the Second Amendment.

 

NOTICE

Although not required, on July 25, 2025, a notification was published on the City’s website.

 

SUMMARY OF FINDINGS AND CITY STAFF RECOMMENDATION

Staff finds the proposed Second Amendment does not alter the intent of the Agreement and is in compliance with the vision of the Comprehensive Plan as expressed in the approved subdivision plan. Based upon these findings, City staff recommends approval of the Second Amendment to the Brighton Crossing Filing No. 7 Development Agreement and has prepared a draft resolution based on these findings.

 

OPTIONS FOR CONSIDERATION

The City Council has three (3) actions it can take after reviewing this application.

1.                     Approve the Second Amendment;

2.                     Deny the Second Amendment; or

3.                     Provide further direction to staff.
