PURPOSE
To consider a resolution approving an IGA with the Urban Drainage and Flood Control District (Urban Drainage), City of Aurora, Commerce City, and Adams County to complete a master plan for Third Creek, authorizing the Mayor to execute said agreement, and to appropriate $15,000 for the completion of the project.
BACKGROUND
Urban Drainage is a regional stormwater authority formed by the Colorado legislature in the late 1960s after massive flooding devastated the Denver Metro area. They are tasked with planning, constructing, and maintaining regional drainageways in conjunction with local governments to protect public health and safety and the environment from serious stormwater events.
Few drainage basins follow municipal boundaries, so creating master plans for these facilities requires cooperation and understanding amongst multiple entities. Third Creek is a major drainageway that intersects Aurora, Commerce City, Adams County, and Brighton. The tributary area also has the potential for rapid and significant development which can significantly increase storm water runoff and its associated potential for flooding.
The proposed IGA will allow the affected entities to cooperatively create a stormwater master plan for the entire basin tributary to Third Creek. This includes doing a baseline study to see current conditions, a data analysis to compare multiple proposed solutions, and finally preparation of the conceptual design for the selected alternative.

FINANCIAL IMPACT
The total project budget is $250,000 that will be split among the participating entities based on their impact on the drainageway.

All participating entities will submit their share of the project budget to Urban Drainage who will then deposit those funds into a special interest bearing fund to pay incrementally for the project as authorized by all participants. Any interest earned on the contributed money can be used on the project without amendment to the agreement; however, no changes will be approved that increases the cost of the project beyond the available funds without an amendment to the agreement. Any funds remaining at the end of the project will be dispersed to the parties at a percent equal to the original fund dedication. Urban Drainage is also contributing an additional $50,000 for related to delineation of flood hazards.
A supplemental budget appropriation of $15,000 must be allocated for this project. Upon Council approval, these funds would be transferred from the Stormwater Enterprise Fund balance into a new capital project budget within the Stormwater Enterprise for Third Creek Urban Drainage Master Planning. Sufficient funds are available in the Stormwater Enterprise Fund balance for this transfer.
STAFF RECOMMENDATION
In order to plan for safe development of the Third Creek Basin at a cooperative, regional level, staff recommends approval of a resolution approving the Urban Drainage IGA.
