PURPOSE
Requesting City Council approval of a formal solicitation for CMAR (Construction Manager At Risk) Services for City of Brighton Municipal Service Center, RFP#21-007046 to the most responsive and responsible bidder, and approving the resolution giving the Mayor authority to sign the contract. Pursuant to Municipal Code Section 3-8-90, all bids and proposals in excess of $50,000.00 shall be awarded through formal written procedures by the City Council.
BACKGROUND/HISTORY
In mid-2019, the City Council directed staff to pursue the construction of a new Municipal Service Center facility that would accommodate Streets Maintenance, Fleet Maintenance, Parks Maintenance, Utility Maintenance and Infrastructure Engineering and Administration, all of which currently operate in separate facilities and locations. In addition, a Police Substation would be located within the facility. The facility is slated to be constructed on 15.54 acres of City owned land at the northwest corner of Main Street and Denver Street in the City of Brighton. The funding for the new facility has been incorporated into the City’s capital budget.
As a part of the development, design and construction of the facility, several steps are involved to accomplish this project. The first step involved a Needs Study and Assessment/Architectural Program.
The Needs Study and Assessment/Architectural Program was completed by City’s consultant D2C Architects in December 2020, reviewed, finalized and approved in January 2021 by members of the MSC Task Force comprised of department representatives representing the occupancy and use of the proposed facility.
The second step involved Conceptual Design and City Council approved Design Services for City of Brighton Municipal Service Center, RFP #21-006682 in March 2021 for D2C Architects to move into Phase I Scope of Services which included several key design elements including completion of 30% design.
The project is now ready to move into CMAR onboarding phase of the design/pre-construction phases.
Before you tonight is the Construction Manager at Risk (CMAR) contract award. At this time the contract amount is only for the pre-construction or design phase of the project but it is the full intent to retain the same contractor for the construction phase as well. The construction phase cost will come back once design has progressed to a level where a Guaranteed Maximum Price (GMP) can be established. The reason for getting the contractor on board during design is to maintain better cost certainty, help value engineer the design, provide constructability review, and many more beneficial aspects that will save the City money on the larger construction cost.
To select the CMAR the City went through a Request for Qualifications (RFQ) process where 7 CMAR firms were shortlisted. Once the submittals were reviewed and evaluated, it was determined to be in the best interest of the City to issue a Request for Proposal (RFP) to all 7 firms.
The City solicited bids on November 9, 2021 from qualified contracting firms to complete CMAR Services for City of Brighton Municipal Service Center, RFP#21-007046. A total of 7 proposals were received on November 23, at 10:00am. All bids received were opened and read into the record by Procurement & Contracts. The proposals were forwarded to the selection committee consisting of various city department staff.

The evaluation team then reviewed the RFP’s and narrowed them down to 4 firms and interviewed the 4 firms on January 5, 2022. After intensive review by the evaluation team, it was very apparent that FCI Construction, Inc. was the best company due to their competitive pricing and experience. Since the intent is to use the same CMAR contractor for both the preconstruction and construction services, the City requested overhead and profit percentages as well as staff multipliers to be submitted for review. Doing this while the contractors are competitively bidding ensures the City will be getting the best pricing during the construction phase and when GMPs and being developed.

Council will be expected to approve several additional contracts over the coming months and year. Examples of future contracts include but are not limited to D2C Architects Phase II, pre-purchase of equipment, a Guaranteed Maximum Price (GMP) from the CMAR, contractors for pipelines, buildings, equipment and other ancillary infrastructure needed to develop and construct the facility.
FINANCIAL IMPACT
Sufficient appropriation exists the budget for this Phase of the City of Brighton Municipal Service Center Project.
STAFF RECOMMENDATION
After complete and thorough review of the submitted proposals by the evaluation team, the recommendation is to award the contract to FCI Construction, Inc. for the CMAR preconstruction services in the amount of $34,500.00
