PURPOSE

To present City Council with an Ordinance for consideration amending Chapter 5 of the Brighton Municipal Code to authorize the operation and licensing of shared electric scooters in the City of Brighton.

BACKGROUND/HISTORY

City staff presented information to City Council at the March 8th Study Session regarding the introduction and use of shared electric scooters in the City of Brighton. City staff was contacted in December 2021 by Bird which is a dockless electric micro-mobility vehicle sharing company regarding the deployment of shared electric scooters for use in the City.

 

Following that presentation and discussion, City Council directed staff to prepare and present an ordinance, for City Council consideration to address the issues of licensing and operating of shared electric scooters shared electric scooters in the City of Brighton.

 

After researching several surrounding communities in regards to shared electric scooters and/or micro electric mobility devices, staff has prepared a proposed ordinance to address this issue.

 

The proposed ordinance would authorize the licensing and operation of shared electric scooters and micro-mobility devices in the City.

 

A few of the highlights of the proposed Ordinance:

 

                     Establishes rules and regulations governing the operation of shared electric scooters and micro mobility devices

                     Requires Licensing ($500 initial license, $200 annual renewal)

                     Revenue sharing requirements

                     Age of operator requirements

                     Operation locations, rules, regulations and restrictions

                     Device design and specification requirements

                     Licensee customer service requirements

                     Safety and Maintenance requirements

                     Device parking requirements and restrictions

                     Data collection and sharing requirements

                     Penalties, fines, suspension or revocation of License

                     Insurance requirements

 

In addition, Department of Public Works and Police Department Staff will present to City Council the 2020 Model Traffic Code for adoption. The updated 2020 Model Traffic Code further defines rules and regulation regarding the use of these devices and would supplement and support an Ordinance.

 

STAFF RECOMMENDATION

Staff would recommends approval of the Ordinance that clearly defines the rules, regulations and licensing of devices in the City.

Approve, amend, or deny the proposed ordinance
