PURPOSE
To consider a resolution acknowledging that there are not sufficient funds in the Stormwater Enterprise to complete a critical piece of stormwater infrastructure called the North Outfall System and also authorizing staff to submit an application for grant funding to complete the remainder of the project.
BACKGROUND
The North Outfall System services a large portion of the northern part of the core City. Per master drainage plans created in conjunction with Urban Drainage, this outfall system is undersized and flows at maximum capacity during even smaller rain events. This creates greater potential for negative stormwater impacts to customers in this area.
The City has been working with Urban Drainage to accumulate sufficient funds to complete this project; however, this is a slow process and will likely be many years before there are sufficient funds available to complete even Phase 2 of the project.
The expected total project cost is approximately $7 million dollars. $1,125,528.05 has been spent to date. With the adoption of an IGA Amendment with Urban Drainage allocating additional funds to the project, there is only $272,820.17 remaining in the project budget. While there are remaining balances in cash funds dedicated to the North Outfall, they fall far short of the required money necessary to complete this project.
CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEM
FINANCIAL IMPACT
This CDBG Grant requires, as a part of the applications, a resolution of our governing body stating that there are not sufficient funds available to complete the proposed project. By submitting the application the City is not committing to spending any additional funds; however, if the application is accepted and the City would like to move forward with the project, a follow-up action by Council may be required to ensure conformity with Finance standard operating procedures and, depending on if the project is fully funded or not, appropriation of additional funds.
STAFF RECOMMENDATION
The North Outfall System is one of the primary stormwater systems for the City of Brighton, and it services a significant portion of the core of the City. Upgrades to this system will further protect customers from damage and inconvenience caused by stormwater events. The State has made funds available for projects such as this one, and as a part of the application process requires a resolution from our governing body stating that there are not sufficient funds available to complete the project. Staff has reviewed stormwater enterprise cash balances and has verified that there are not sufficient moneys available to complete even half of the project.
For these reasons, staff recommends approval of a resolution acknowledging that there are not sufficient funds for the completion of the North Outfall Project and also authorizing staff to submit an application to the State for the grant.

· Postpone consideration of the resolution as presented with direction to staff to make modification or clarification to the resolution
