PURPOSE
Requesting City Council approval of a Contract Amendment for Project # 17-016 Veterans Park Water Quality and Terrain Enhancement Project, to raise the previously approved, not to exceed, contract value giving the City Manager, or Designee, authority to sign the contract. Municipal Code Section 3-8-178, “All change orders greater than Twenty-Five Thousand dollars ($25,000) or change orders in aggregate greater than twenty-five percent (25%) of the original contract amount shall be approved by the City Council.”

BACKGROUND/HISTORY
The Colorado Front Range Trail (CFRT) - Veterans Park Trail Section project began in 2017. All of the CFRT was completed except the approximate 450-feet of trail along Colorado State Highway #7 (West Bridge Street) by November 2017. This project was part of a larger Utilities Department project with Colorado Department of Transportation (CDOT). The Utilities Department project never occurred and CDOT held up the project until they released the City from the grant contract. No CDOT grant funds are used for the trail design and construction. This project has been a high priority from City Council to have completed. Last year, 2020, CDOT approved allowing the Parks and Recreation Department to finish the CFRT trail within the CDOT right-of-way along Highway #7 with several additions to the trail construction and a new permit. The permit is to be requested from CDOT 6-8 weeks prior to construction occurring in the right-of-way. The permit will be applied for in May 2021, after City Council approval of this Change Order.
The original project costs are based upon 2017 numbers. In nearly four years (2017 to 2021) that this 450-feet of trail construction has been in a CDOT waiting pattern; the costs for concrete, required additional storm sewer facility and manhole, design, mobilization and erosion control, required traffic control, and importing of embankment material has gone up since 2017. Because of the increase in costs for the above items, there is a need for a Change Order in the amount of $49,980.00 - see attached. The project has sufficient funding in the 2021 Budget to cover the increased costs.
Upon approval of this Change Order by City Council, the Parks and Recreation Department will submit the new permit, new plan drawings, and other items needed for the CDOT permit. Upon approval by CDOT, the approximate 450-feet of trail will be built in 2021.
FINANCIAL IMPACT
Sufficient appropriation exists for the project.
STAFF RECOMMENDATION
Staff recommends that the City Council accept the presented Change Order and approve the request to issue a Contract Amendment to Granicus, Inc raising the, not to exceed, contract value by $49,980.00. This is 11.0% of the contract value of $468,234.50.
