PURPOSE
Requesting City Council’s approval of the procurement of the real property acquisition and approving the resolution giving the City Manager, or designee, authority to sign the contract.  Per City Code Section 3-8-30, “…(b) All materials, services, and construction contracts, except as otherwise provided in this Article, with an estimated cost greater than one hundred thousand dollars ($100,000.00), shall be awarded through the formal solicitation procedure or the formal RFP process by the City Council. After due notice inviting bids, purchase orders and contracts shall be awarded to the lowest responsive and responsible bidder.”

 

BACKGROUND/HISTORY

The City of Brighton Public Works Department is currently designing the Sable Blvd Corridor and has developed concept design plans. Right-of-way acquisition will exist along the corridor. One parcel (13590 Sable Blvd, Brighton, CO 80601, Parcel #: 0156930003001) located on the southeast corner of 136th and Sable Blvd has been listed for sale on the multiple listing service. The current list price is $690,000 and has been identified as a significant amount of right-of-way needed from this parcel.  The total amount with all transaction costs, professional services, and the cost of the property would not exceed $740,000.

The history of Sable Blvd is that it was formerly State Highway 2 owned by the Colorado Department of Transportation until 2011 when it was transferred to the City of Brighton. The roadway segment is unique with the conservation easements, agricultural, mixed with residential, and parallel to US-85. Additionally, the route is a key entry point to the City of Brighton that will serve as an icon of the history and future of the city.

The parcel of interest was listed for sale on or about August 1, 2026 by the owner. The real estate agent has been contacted and notified that right-of-way acquisition associated with this parcel is planned in the future, along with the intersection and roadway widening. Due to the location of the parcel directly adjacent to the intersection of 136th Avenue and Sable Blvd, the residence would significantly be impacted such that the access points would be severely restricted, the majority of the front of the parcel would be consumed with right-of-way, and the owners would need to be relocated. It is in the best interest to acquire a parcel that is already being offered on the open market, as opposed to normal right-of-way acquisition while a property is occupied.

FINANCIAL IMPACT

Sufficient appropriation exists for the project.

 

STAFF RECOMMENDATION

Staff recommends that the City Council approve the real property acquisition of the parcel, along with all the necessary transaction and professional service costs, to obtain the necessary right-of-way for the transportation improvements on Sable Blvd and the intersection of 136th Avenue in the amount of up to $740,000.
