PURPOSE
To approve a bid in response to the formal solicitation for project # 21-007095 to the most responsive and responsible bidder and a resolution giving the City Manager, or Designee, authority to sign the contract. Municipal Code Section 3.08.090, “…All bids and proposals in excess of $50,000 shall be awarded through formal written procedures by the City Council.”
BACKGROUND
The City of Brighton has had a partnership with South Adams County Water and Sanitation for many years. There is an Intergovernmental Agreement (IGA) in place that discusses Brighton’s partnership with South Adams near 120th and Peoria involving areas that South Adams services even though it is in Brighton city limits. An updated IGA will be coming to City Council for approval in the next few weeks outlining the terms of the agreement for the interconnection and assuming service for those in Fuller Estates.
Staff has pursued discussions about Brighton purchasing water from Denver and creating an interconnect with South Adams to transport the water to Brighton’s distribution system. The purpose of the connection is for emergency supply and peak supply as well as to meet existing regional commitments. It was determined that the best location for the interconnect is at 112th and Peoria. The IGA will address conveyance of the water, servicing residents in Fuller Estates, and in the next few years, to connect and provide service to other properties within Brighton currently being served by South Adams. The interconnect will allow servicing the existing residents in Fuller Estates. The connection point would serve two purposes, an interconnect for Brighton to receive water from Denver, as well as Brighton serving Fuller Estates.
The City of Brighton solicited a Request for Proposal on 11/8/2021. We received four bids. Evaluations of the bids were completed by the Utility staff.

FINANCIAL IMPACT
Sufficient appropriation exists for the project.
STAFF RECOMMENDATION
Staff recommends that the City Council approve the request to issue an award to Garney Construction as the lowest most responsive and responsible proposer.
