PURPOSE
Requesting City Council’s approval of the procurement for 21-007057 ADA Restrooms at Historic City Hall Construction by awarding a contract to Wilderness Construction, LLC, rescinding Resolution #22-061, and approving the resolution giving the City Manager, or Designee, authority to sign the contract. Per City Code Section 3-8-90 “ All materials, supplies, equipment, service and construction contracts, except as otherwise provided in this Article, with an estimated cost of greater than fifty thousand dollars ($50,000.00), shall be awarded through the formal bid process or the formal RFP process by the City Council. After due notice inviting bids, purchase orders and contracts shall be awarded to the lowest responsive and responsible bidder.”

BACKGROUND
This project proposal is to renovate the first floor bathrooms in Historic City Hall to ensure that they are compliant with the Americans with Disabilities Act (ADA). Prior to demolition, these bathrooms did not provide sufficient space to accommodate people with disabilities. Renovation of these bathrooms will provide ample space for people who use wheelchairs, automated doors, and other accessories such as a fire alarm system.
In 2021, the City of Brighton was awarded a Community Development Block Grant (CDBG) from Adams County, an agreement approved by Council. CDBG funds are federal funds that are allocated towards low to moderate-income neighborhoods. Past projects that have used CDBG funds include Minor Home Repair as well as sidewalk improvements. This project was delayed due to labor and material shortages which resulted in the need to bid the project out three times before a sufficient response was received.
On May 17, 2022, City Council awarded a contract to American Construction Services, LLC in the amount of $220,709. In June 2022, American Construction Services notified the City that they would not be able to proceed with the project, citing labor and supply issues. Staff is now recommending award to Wilderness Construction, the second respondent to the third solicitation.
FINANCIAL IMPACT
The Community Development Block Grant awarded $257,000 to the City. $18,947 of the grant amount was spent on design services. The vendor’s bid comes in at $248,919; therefore, the City will contribute $10,016 for the completion of this project.
STAFF RECOMMENDATION
Staff recommends that the City Council approve the request to issue an award to Wilderness Construction, LLC, rescind the resolution awarding the contract to American Construction Services, LLC, and authorize the City Manager to execute the contract on behalf of the City.
