PURPOSE
Requesting City Council approval for the procurement of 24-008751 South Brighton Utility Installation (AKA South Adams County Water Sanitation District (SACWSD) Disconnect Construction) by awarding a contract to BT Construction, Inc., deemed the most responsive and responsible bidder of the bids received in response to the published solicitation, and approving the resolution giving the City Manager, or designee, authority to sign the contract. Per City Code Section 3-8-30(b): “All materials, services, and construction contracts, except as otherwise provided in this Article, with an estimated cost greater than five hundred thousand dollars ($500,000) shall be awarded through the formal solicitation procedure by the City Council. After due notice inviting bids, purchase orders and contracts shall be awarded to the lowest responsive and responsible bidder.”
BACKGROUND / DISCUSSION
The City of Brighton and SACWSD entered into a Settlement Agreement dated June 11, 1997, and an amendment to said Settlement Agreement dated August 17, 2010, pursuant to which the parties allocated rights and obligations with regard to South Adams' provision of water and wastewater service to certain areas within the southern part of Brighton or Brighton's growth area, which areas are generally outside of, adjacent to, and to the north of South Adams' service area. In these prior agreements, the City agreed to provide full service to the areas by extending its own system by 2015, thus replacing and eliminating the need for further District service to the area. However, the City did not extended its system to some of the areas served by the District by that deadline.
The City and SACWSD entered into an Intergovernmental Agreement (IGA) in 2022 to establish new timelines and requirements for Brighton to serve the areas with water and sewer services. The IGA requires the City of Brighton to serve four areas with water and/or sewer services:
1. Fuller Estates Subdivision - The City must install a water line in Peoria Street to serve specific customers between 112th and 120th Avenues by December 31, 2022. This task has been completed. The City must also install a new water line in 112th Avenue to serve customers with water. This is a part of this specific project and is required to be completed by December 31, 2025.
2. Shiraba Park - The City must install water and sewer lines to serve customers within the Shiraba Park subdivision with water and wastewater services. This is a part of this specific project and must be completed by December 31, 2025.
3. Services to School District 27J Maintenance Facility - The City must serve the Maintenance Facility with sewer service by December 31, 2024. This was completed earlier this year.
4. Services to the Singh Sabha Temple - There is no timeline for service established in the IGA. The customer is far outside the City’s current service boundary.
The current project will complete all requirements of the IGA, with the exception of item #4 listed above. Per the IGA, the City will continue to make good faith efforts to serve this customer in the future.
The current project includes the installation of approximately 2,900 linear feet of water line and over 1,500 linear feet of sewer line to meet the requirements of the IGA.
STAFF RECOMMENDATION
Approval of the Resolution as drafted accepting the proposal of BT Construction, Inc and authorizing the City Manager, or designee, to sign the project contract after consultation with the City Attorney.
