PURPOSE
A Resolution approving the Purchase and Sales Agreement between the City of Brighton and the City of Brighton Housing Authority for the purchase of 0.219 acres of land located at 781 S. 5th Ave. Brighton, CO 80601 to be used as a Community Garden Site and authorizing the City Manager to execute the agreement on behalf of the City of Brighton.

BACKGROUND

The City of Brighton currently leases the property located at 781 S. 5th Ave. from the City of Brighton Housing Authority.  The City uses the property to provide a Community Garden Site.  The Community Gardens was constructed in 2013 with a grant from Tri-County Health Department.  The Brighton Housing Authority has communicated to the City of Brighton that they wish to sell the property located at 781 S 5th Ave. to the City.  The Brighton Housing Authority purchase the property in 2008 for $50,000.  The City will pay the Brighton Housing Authority $50,000 for the property.  At the time of the construction of the Community Garden the Utility Department provided a ¾” water tap with the stipulation that when the property was sold the owner would pay for the water tap.  The Recreation Capital fund will pay for the water tap in the amount of $18,633.00

FINANCIAL IMPACT

Funds are available in the Recreation Capital Fund to purchase the land for $50,000 and the water tap for $18,633.

STAFF RECOMMENDATION

Staff Recommend Approving the Resolution.  This is a very popular Community Garden and is always well maintained.
