PURPOSE
Requesting City Council’s approval of the procurement of 22-007761 Aichelman Property - Phase I (the “Project”) by awarding a contract to American West Construction, LLC, deemed the most responsive and responsible bidder of the four (4) bids received in response to the posted solicitation, and approving the resolution giving the City Manager, or designee, authority to sign the contract. Per City Code Section 3-8-30(b): “All materials, services, and construction contracts . . . with an estimated cost greater than one hundred thousand dollars ($100,000.00), shall be awarded through the formal solicitation procedure or the formal RFP process by the City Council.”

BACKGROUND
Situated in the Ken Mitchell Open Space in the section designated as the Aichelman Property, the proposed work consists of completing phase 1 of the Project. Phase 1 includes: mobilization and demolition, surveying, storm water protection, earthwork and soil preparation for paving, placing and compacting the aggregate base course, hot mix asphalt paving of parking lot and road, concrete curb ramps 6-inch deep by 10-feet wide concrete trails, an overflow spillway and grouted riprap rundown, finish grading and soil preparation for seeding and mulch around parking lot and trail, boulders, electrical trenching, trash receptacles, bike racks, pet waste stations, signage, and all other associated work to complete the project.
Four (4) formal sealed proposals were received, opened, and recorded by Procurement. The high bid was at $2,114,392.04 and the low bid was at $1,696,107.00. American West Construction, LLC, was the most responsive and responsible bid to perform the required services.
CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEM
Approving American West Construction, LLC’s bid will allow the City to sign a contract with them for the construction of the Aichelman Property - Phase 1 project. Additionally, the City of Brighton has been approved for $818,400.00 in Adams County Open Space Passive Grant funding.
FINANCIAL IMPACT
Sufficient funding is within the 2022 Parks and Recreation Capital Budget and will be approved in the 2023 Parks and Recreation Capital Budget. The bid from American West Construction, LLC of $1,696,107.00 is within the projected budgeted amount for the project.
STAFF RECOMMENDATION
It is recommended that City Council approve the awarding of a contract to the most responsive and responsible bid to perform the required services of American West Construction, LLC for construction project 22-007761 Aichelman Property - Phase I in the amount of One Million, Six Hundred Ninety-Six Thousand One Hundred Seven Dollars ($1,696,107.00).
