Reference:                     Utility Repair and Construction: Master Price Agreement Awards

To:                                                               Mayor Gregory Mills and Members of City Council

Through:                                          Michael P. Martinez, City Manager

Prepared By:                     Scott Olsen, Director of Utilities

Date Prepared:                     February 5, 2026

PURPOSE
Requesting City Council’s approval for the procurement of 25000418M.1 As-Needed Utility Repair and Construction Services by awarding a Master Price Agreement to American West Construction, LLC, CL Water Solutions, Inc. and Timber Wolf Excavating, LLC  deemed among the three most responsive and responsible proposers of the seven (7) proposals received in response to the published solicitation. Per City Code Section 3-8-180, “Master price agreements with an annual not to exceed price of five hundred thousand dollars ($500,000.00) or less may be approved by the City Manager. Master price agreements with an annual not to exceed price greater than five hundred thousand dollars ($500,000.00) shall be approved by the City Council. After the City Council has approved a master price agreement, the City Manager may approve an annual extension and any amendment thereto, provided the contractor has performed the work satisfactorily, all terms and conditions of the contract have been fulfilled, the funds for said extension and amendment have been appropriated, and the annual not to exceed dollar amount of said extension or amendment has not increased from the original master price agreement.”

BACKGROUND

This item was originally presented at the February 10, 2026 City Council Study Session.

City staff are tasked with numerous maintenance, operation and construction activities annually, some of which extend beyond the abilities of the City’s equipment and expertise. In order to ensure continuity of operations, contracted vendors with specialized equipment/expertise are required to perform certain tasks. Examples of such tasks include:

Excavation to depths outside City equipment ability

Excavations that include complex dewatering operations due to groundwater

Installation of pipe/materials that cannot be moved by City equipment

                     Repairs to critical infrastructure

Installation of large extents of new piping

At times, these services are needed in emergency situations that require quick response times. The vendors selected for award have made it clear they can respond as outline in the Request for Proposals.

Master Price Agreements are used to effectuate the above tasks and respond to emergency situations.

FINANCIAL IMPACT

Sufficient appropriation exists in the Utilities operating budgets for as-needed and emergency maintenance and construction activities.
