PURPOSE
The applicant, GKT Brighton Residential Development, LLC and Prairie Center Metropolitan District No. 7, and Prairie Center Metropolitan District No. 3 (“Prairie Center”) represented by Mike Tamblyn is requesting Development Agreement Amendments for Prairie Center Village I and Prairie Center Village V.

BACKGROUND
The City approved the Prairie Center Mixed Use PUD in 2008. In the Mixed Use PUD, the Lutz Parcel and surrounding land is indicated as Open Space. As part of the design of the regional drainage system for Prairie Center, the Lutz Parcel is being used by Prairie Center at this time for existing development in Prairie Center.
In 2015, the City approved the Final Plat for Village V of Prairie Center, which is the area south east of Eagle Boulevard and 27th Avenue and contains the Elements and Avilla multi-family projects. In the agreement for Village V, the City agreed to take the Lutz Parcel as part of the park and open space dedication 120 days after the City’s approval of the Final Plat. However, the Parks and Recreation department doesn’t have the staff or resources to manage this large area and has asked that Prairie Center retain the area for a few more years.
In 2017, the City approved the Final Plat for Village I of Prairie Center, which is the area north east of Eagle Boulevard and 27th Avenue and contains the Village at Prairie Center, which is a single family detached subdivision. The terms of the Village I Development Agreement referenced Village V and the Lutz dedication. As noted above, the proposal for the dedication of the Lutz Parcel in the Development Agreement is proposed to be extended for 2 years for a total of 6 years after the final approval of the Village V Final Plat; thus, the Lutz parcel would be turned over to the City in 2021.
In reviewing the Development Agreement for Village V, Prairie Center requested to revise the trail phasing for Village V. The trail as constructed varied from the original exhibit, and phasing for the final leg on Lot 3 was not specified. The revised Village V Agreement contains revised language for the construction of the final leg of the trail in Village V.
A few additional amendments have been requested by Prairie Center for the Village I Development Agreement, including:
• The phasing of water dedication for phases 2, 3, and 4. The original agreement required the dedication of all water shares for all remaining phases prior to the start of phase 2. The proposed amendment as requested by Prairie Center is to dedicate the water shares for each phase prior to the start of that phase.
• The timing of water dedication with respect to the Tract A pond. The original agreement required the dedication of water at 4 years after the approval of the Village I final plat (December 19, 2017). The proposed amendment as requested by Prairie Center is to dedicate the water shares for Tract A at 6 years after the approval of the Village I final Plat or when the adjacent Village II final plats, whichever is sooner.
CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEMS
The Comprehensive Plan calls for the continuing support of development of Prairie Center as an urban center, including development of housing, additional retail opportunities and other regional-scale amenities. Working with Prairie Center on these amendments continues the forward development of the project with more housing to support additional retail, employment and regional development.
STAFF ANALYSIS
The proposed Agreement Amendments are necessary to change the timing of the Lutz Parcel dedication as the City is not ready to take on the maintenance or management responsibility for the property. The additional amendments for the trail and open space table are considered clarifications on the existing agreement terms and are not substantive policy issues. The water dedication for the remaining phases of Village I is a reasonable request noting the large amount of water needed for these phases. The Tract A pond, in Village I, is an existing pond that is currently not irrigated and is landscaped with native vegetation. The location of Tract A is on the northern side of Village I, and will be a visible feature of the future Village II. Staff agrees that water dedication for the landscaping and irrigation of this tract with Village II is logical as water is currently not being used to maintain the existing landscaping in and around the pond.
Development Review Committee (DRC) Review:
The Development Agreement Amendments have been reviewed and recommended for approval by the City’s Development Review Committee (DRC) and the City Attorney.
SUMMARY OF FINDINGS AND STAFF RECOMMENDATION
Staff has reviewed these agreement amendments and finds them consistent with supporting the development of Prairie Center. Based on staff’s recommendation, draft resolutions approving the Development Agreement Amendments have been provided.
OPTIONS FOR COUNCIL CONSIDERATION
The Council has four (4) choices it can make after reviewing these applications. The Council may, together or separately:
(1) Approve the Development Agreement Amendments, or
(2) Approve the Development Agreement Amendments with any changes or conditions, or
(3) Deny the Development Agreement Amendments, or
(4) Continue the Development Agreement Amendments applications to a specific date in the future.
