PURPOSE

The Grant of Easement document (“Easement”) before the City Council is for the purpose of granting perpetual easements over the City of Brighton property to United Power, Inc. (the “Applicant”) for the purpose of installing utility power lines. The easement will be placed north of the Bridge Street Widening improvements so the existing utility power lines will be relocated outside of the project limits.

 

BACKGROUND

During the design phase of Bridge Street Widening, there were a number of relocations of third-party infrastructure that were identified as necessary to complete the Bridge Street Widening project. United Power has facilities that were identified in areas to be relocated due to the new City of Brighton underground infrastructure.

 

United Power was provided the project information and then proceeded to design the relocation, including obtaining easements to perform the installation of the new utility power lines through boring and excavation operations to place the infrastructure. 

 

CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEM

Grant of Easement:

When reviewing the Easements, the City Council should consider whether the granting of the Easements will not prejudice the best interests of the City.

 

STAFF ANALYSIS

The request for the Easement benefits the City of Brighton because it relocated existing utility power lines and allows the underground infrastructure construction as part of the Bridge Street Widening project.

 

STAFF RECOMMENDATION

City staff finds that the Easement does not prejudice the best interests of the City, and therefore recommends approval of the Easement by City Council. The easement agreements have been reviewed and approved by the City Attorney’s Office.

 

OPTIONS FOR COUNCIL CONSIDERATION

The City Council has four options when reviewing the Grant of Easement. City Council may:

1.)                     Approve the Grant of Easement via Ordinance as drafted;

2.)                     Approve a modified Grant of Easement via Ordinance;

3.)                     Deny the Ordinance with specific findings to justify the denial; or

4.)                     Continue the item to be heard at a later, specified date if the Council feels it needs additional information to ensure compliance with the approval criteria.
