Mayor Mills read the title of the Ordinance into the record.
Mayor Mills opened the public hearing at 6:25 p.m. and City Clerk Natalie Hoel verified the required postings and publications (June 27, 2024 on the City of Brighton website) for this public hearing were completed.
Associate Planner Stephanie Iiams presented the Adams Point Zoning Map Amendment. The property is 7.387 acres and is located north of East Bridge Street, south of Longs Peak Street, east of North 19th Avenue and west of the Fulton Ditch. The request is to rezone the property form C-3 (General Retail & Services) to R-3 (Multiple Family Residential) under the City of Brighton. The property was annexed as part of the Courthouse Annexation and is currently platted under the Fulton Plaza Filing No. 1 Final Plat. The R-3 District provides residential living in a moderate-density pattern in suburban neighborhoods located in areas that have transition between lower-density neighborhoods or more intense non-residential uses where a high level of accessibility, public amenity and support services are immediately available. Row Houses, Apartments and Senior Living are allowed uses.
City Council shall use the criteria in Section 2.03 B of the Land Use & Development Code. The properties rezoning will help support policies of the Comprehensive Plan. The Future Land Use portion of the Comprehensive Plan has designated this area as public land. This designation encourages the public use of the land by governmental, quasi-public, or non-profit entities like the Brighton Housing Authority, the property owner and applicant for the project. The proposed zoning map amendment meets other policies of the Comprehensive Plan. Housing intensity and diversity should increase along locations where high intensity employment/retail exists and along major corridors to create a successful use of land uses. The proposed rezoning would increase the high-density residential development in the area and concentrate multi-family development near Downtown and along the major corridor. Given the surrounding commercial developments to the south and west, and residential development to the east, this proposed rezoning would aid in the creation of a mixed-use corridor. Bridge Street has the potential to become a main street with homes, farms, and commercial centers lining its edges with building intensities increasing near Downtown. As Bridge Street is the primary east/west commercial corridor in the city, infill development should be encouraged to further improvements in the appearance, value of investments, and pedestrian and bicycle systems in the corridor.
The proposed zoning map amendment advances a number of the goals in Chapter 4 of the Comprehensive Plan. The property is within an area of existing infrastructure and along a major arterial roadway. Any future development will build upon the established framework of roads, utilities, and other public amenities promoting infill development and prioritizing sites that are highly visible. The zoning of the property will support the balance between residential and non-residential districts in the area. The proposed zoning would integrate into the existing mixed-use vision for the area as well as encourage diverse types of housing development for the full spectrum of incomes and meet the needs of all ages and walks of life. The property can be adequately served and any future site developer will pay applicable costs to connect to city infrastructure. The development of the property as residential aligns with the character of the area and the desire for higher density residential near commercial centers and an accessible mix of land uses. The proposed rezoning will provide more opportunities along Bridge Street while providing corridor improvements. Staff finds that this site is appropriate for residential uses. Site development will occur in accordance with the applicable zone district standards in the Land Use & Development Code. Any development of the property will only be permitted with a design that ensures it fits in with the context and development patterns of the area.
All postings were completed in accordance with the Land Use & Development Code. Information was also posted on various social media sites. A neighborhood meeting was held on November 8, 2023. Planning staff received two formal letters of support for the rezoning. The Development Review Committee reviewed the project and recommended approval. The Planning Commission heard the request on June 13, 2024 and unanimously recommended approval. Staff finds that the Zoning Map Amendment complies with the requirements as outlined in the Land Use & Development Code. Staff recommends approval of the Adams Point Zoning Map Amendment.
Mayor Mills asked if the applicant would like to add anything to the presentation.
Marcus Pachner, land use and community outreach consultant for the Brighton Housing Authority. Mr. Pachner presented the history of the site at 19th Avenue and Bridge Street. The team reached out to all adjacent property owners and the broader community last year to get information regarding the need for affordable housing. The request is to rezone the property from C-3 to R-3 for a residential development that compliments the Bridge Street corridor and helps to meet the housing needs in the city.
Mayor Mills asked if anyone in the audience wished to speak on behalf of or against the request, there was none.
Mayor Mills asked if any correspondence had been received. City Clerk Natalie Hoel presented the correspondence that was received and was directed to add the letter of support to the packet.
Mayor Mills asked if there were questions from City Council.
Councilmember Pawlowski asked what will be done about parking in the area. Debra Bristol with the Brighton Housing Authority explained that the parking will be designed in accordance with the requirements in the Land Use & Development Code. Councilmember Pawlowski asked for an explanation of the parking requirements and Planner Iiams explained that the parking standards depend on the bedrooms per unit. Councilmember Pawlowski asked if there would be a parking garage and Ms. Bristol explained that it will be surface parking.
Councilmember Snyder asked how many units are in the development and will all meet the 60% AMI requirement. Ms. Bristol explained that this will be a two-phased project with 90 units in the first phase with the hope to double those units in the second phase. This will be a low-income housing tax credit property.
Mayor Mills closed the public hearing at 6:44 p.m.
