1. CALL TO ORDER
Mayor Mills called the meeting to order at 10:02 p.m.

Present: 9 - Mayor Mills, Mayor Pro Tem Johnston, Councilmember Blackhurst, Councilmember Cushing, Councilmember Humbert, Councilmember Jordinelli, Councilmember Pollack, Councilmember Taddeo, and Councilmember Watts
2. APPROVAL OF REGULAR AGENDA
Motion by Mayor Pro Tem Johnston, seconded by Councilmember Blackhurst, to approve the Regular Agenda as presented. Motion passed by the following vote:
Aye: 9 - Mayor Mills, Mayor Pro Tem Johnston, Councilmember Blackhurst, Councilmember Cushing, Councilmember Humbert, Councilmember Jordinelli, Councilmember Pollack, Councilmember Taddeo, and Councilmember Watts
3. EXECUTIVE SESSION
Motion by Mayor Pro Tem Johnston, seconded by Councilmember Humbert, to go into Executive Session at 10:04 p.m. for discussion of a personnel matter under C.R.S. Section 24-6-402 (4)(f) and not involving: any specific employees who have requested discussion of the matter in open session; any member of this body or any elected official; the appointment of any person to fill an office of this body or of an elected official; or personnel policies that do not require the discussion of matters personal to particular employees regarding the Deputy Municipal Judge. Motion passed by the following vote:
Aye: 9 - Mayor Mills, Mayor Pro Tem Johnston, Councilmember Blackhurst, Councilmember Cushing, Councilmember Humbert, Councilmember Jordinelli, Councilmember Pollack, Councilmember Taddeo, and Councilmember Watts
Mayor Mills reconvened the meeting at 10:32 p.m.
Mayor Pro Tem Johnston reported that he was unable to leave the breakout room right away and there was another participant that was expected in the Executive Session waiting to come into the room.
City Manager Jane Bais DiSessa announced that she just received notice that the Judge was in the room and asked the City Attorney how to handle this.
City Attorney Jack Bajorek explained that ultimately the decision was up to City Council. There is no point in going back into Executive Session since Council has already left Executive Session. If Council would like to go back into Executive Session to communicate with that person, Council can do so. This would require a second motion to go back into Executive Session.
City Manager Bais DiSessa stated that Assistant City Manager Karen Borkowski Surine reported that he came in at 10:22 p.m.
Councilmember Taddeo is all for allowing him to speak, but asked if it would change anyone’s mind.
City Attorney Bajorek cautioned Council that any discussion should be done back in Executive Session.
Motion by Councilmember Cushing, seconded by Mayor Pro Tem Johnston, to return to Executive Session at 10:36 p.m. Motion failed by the following vote:
Aye: 5 - Mayor Mills, Mayor Pro Tem Johnston, Councilmember Cushing,
Councilmember Humbert, and Councilmember Watts
No: 4 - Councilmember Blackhurst, Councilmember Jordinelli, Councilmember Pollack,
and Councilmember Taddeo
4. ADJOURNMENT
Motion by Mayor Pro Tem Johnston, seconded by Councilmember Humbert, to adjourn at 10:38 p.m. Motion passed by the following vote:
