PURPOSE
Requesting City Council’s consideration of a contract amendment to the Lupton Meadows Reservoir Design Services contract between the City of Brighton and Engineering Analytics, Inc. in the amount of $1,171,024 for Engineering Services During Construction.

 

BACKGROUND

City Council previously approved a design contract with Engineering Analytics, Inc. for the Lupton Meadows Reservoir improvements. That original design contract anticipated a contract amendment for Engineering Services During Construction. It is typical in the industry to contract with the Engineer of Record (EOR) for such services due to liability and design interpretation reasons.

 

At this time, the Issue for Bid (IFB) civil plan set has been completed. City Council also previously approved a Purchase and Sale Agreement (PSA) related to the Lupton Meadows Reservoir outlining an exchange of water bank credits for ownership of the property, certain water rights and $17M toward construction costs for the project. 

 

Engineering Services During Construction are required to ensure the reservoir project is built per the design and functions appropriately. The scope of the services include, but are not limited to:

•                     Final design phase services not previously contracted:

o                     Ft. Lupton Special Use Permit application support

o                     Erosion protection alternatives for cost savings

o                     Coordination on regional trail with Ft. Lupton

•                     Pre-bid Services:

o                     Bid document support and review

o                     Bid question response support

•                     Issue for Construction (IFC) civil plan set and final specifications

•                     Construction phase services:

o                     Progress meetings

o                     Requests for Information (RFIs) and submittal review

o                     Construction oversight

•                     As-built documentation

The use of reservoir water storage requires a Special Use Permit through the City of Ft. Lupton, which staff will be applying for shortly. It is anticipated that Construction Services for the improvements will be solicited in January 2027, depending on the closing schedule in the PSA and the Special Use Permit process.

 

STAFF RECOMMENDATION

At a future City Council meeting, staff recommend approval of the resolution as drafted, incorporating the contract amendment.
