PURPOSE
To facilitate the financing of public improvements and the long-term maintenance of specific infrastructure within the development known as the Brighton Crossing Annexation, inclusion of the annexation area into the Brighton Crossing Metropolitan District No. 7 (the “District”) is necessary. As part of this process, the City of Brighton (the “City”) City Council may consider a resolution consenting to the inclusion of the annexation area within the District. Inclusion into the District allows for the management of funding and ongoing maintenance responsibilities, such as common elements and other public infrastructure, once the annexation area is subdivided.
PROCESS
In accordance with the approved Service Plan for Brighton Crossing Metropolitan District Nos. 5-8, approved on September 19, 2017, the District shall not include any properties into its boundaries without the prior consent of the City Council, which consent shall be evidenced by resolution.
BACKGROUND
The Annexation is for an approximately 7.712-acre property (the “Property”), generally located to the north of East Bridge Street, south of the future Royal Pine Street, east of the future Golden Eagle Parkway alignment, and west of I-76.
A Petition for Annexation was accepted by the City Council at a regular meeting held on September 2, 2025, at which time the City Council found that the Petition was in substantial compliance with the applicable annexation laws of the State of Colorado. On October 7, 2025, the City Council held a public hearing and approved at first reading both the Annexation Ordinance and the Zoning Map Amendment Ordinance.
On October 21, 2025, the City Council will hear and vote on the resolution to approve the Brighton Crossing Annexation Agreement, to which a condition of the Annexation is to include the Property within the District’s inclusion area boundary.
OPTIONS FOR COUNCIL CONSIDERATION
The City Council has the following four options:
1. Approve the Resolution as drafted;
2. Approve a modified Resolution;
3. Deny the Resolution with specific findings to justify the denial; or
4. Continue the item to be heard at a later, specified date if the Council feels it needs additional information to ensure compliance with the approval criteria.
