PURPOSE / BACKGROUND
City Council and staff have made it a priority to improve the current status of Medical Center Drive as the current state of the roadway is impacting access to Platte Valley Medical Center. Complaints are regularly fielded by the City from the leadership of Platte Valley Medical Center regarding the roadway’s condition. Previous executive sessions by City Council have been held on the negotiations surrounding this matter and the drafted agreements (one for each of the two subject developers) are the result of said negotiations that achieve the goal of completing the final lift of asphalt for Medical Center Drive.

CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEM
Typical roadway specifics in terms of design and construction are usually worked out and agreed to in a Development Agreement that is approved with a Final Plat. The work required to bring the roadway to a final state was delayed to accommodate construction efforts that would impact the roadway. Prior agreements made by the developer or associated predecessors assigned the responsibility of final construction of the roadway to THF Prairie Center Development, LLC (THF) and S3L Holdings, LLC (S3L). This project has the potential to provide costs savings to the developers related to items such as mobilization by participating with the City to complete its obligated portion.
The Acting City Manager and City Attorney have agreed to the attached draft agreements and have determined that their approval is in the best interest of the City. Additionally, THF and S3L have given their consent to their appropriate agreement as drafted.
SUMMARY OF AGREEMENTS
The significant provisions of the draft agreements include outlining that the City will design, bid out, and build the top lift of the roadway where it is missing. The two developers of the adjoining properties will agree to reimburse the City for their proportionate costs. THF will be responsible for two-thirds and S3L will be responsible for one-third of the cost of the roadway improvements. This split is proportionate with their associated frontage and obligation. The estimated costs to the developers for their applicable portions are $441,000 for THF and $220,000 for S3L. A full scope of work is attached to the draft agreements.
STAFF RECOMMENDATIONS
Staff is recommending adoption of the two resolutions as drafted granting approval of their accompanying agreement. It is in the best interest of the City and the developers to complete the roadway before any further deterioration of this portion of Medical Center Drive occurs. All in Brighton are best served by well-maintained arterials, and the City would like to have the roadway finished before winter weather becomes prevalent.
OPTIONS FOR COUNCIL CONSIDERATION
The City Council has four options when reviewing each agreement:
1) To approve the item as presented via resolution;
2) To approve the item with changes or conditions via resolution;
3) To deny the item; or
4) To continue the item to be heard at a later specified date.
