PURPOSE
Review the Annexation Petition, make a finding of substantial compliance, and schedule a public hearing for September 1, 2015, for the annexation of two parcels, 1.590 acres and 1.208 acres, to be known as the North Star Annexation.
In order to proceed with the annexation of this property, the Council must find that the petition is in substantial compliance with the Colorado Statutes and consider a resolution to approve the Annexation Petition and set a date, time and place for a public hearing which must be set at least thirty (30) days and no more than sixty (60) days after the effective date of the Resolution, to determine if the request for annexation meets the requirements of the Colorado Revised Statutes 31-12-104 and 105.
SUMMARY
An Annexation Petition, requesting annexation of two parcels, 1.590 acres and 1.208 acres, to be known as the North Star Annexation (the "Property"), was submitted to the City of Brighton. The Annexation Petition is signed by Theodore Shipman, North Star Equities, LLC. The Property is located east of S. 50th Avenue and is off of Grosbeak Street and also includes a portion of the 50th Avenue right of way. The Property is 100% contiguous with the existing Brighton city limits.
PROCESS
The City Council must determine whether the Annexation Petition complies with Section 31-12-107(1), of the Colorado Revised Statutes. If Council determines that the Petition is in substantial compliance with the statutory provisions, the following procedure applies:
