PURPOSE
To establish an Intergovernmental Agreement with the Adams County Sheriff's Office and the Cities of Aurora, Federal Heights, Commerce City, Northglenn, Thornton and Westminster for a system to safely and promptly have defendants that are in custody appear before the respective jurisdictions Judge as required by law.

BACKGROUND
In response to House Bills 17-1338 and 16-1309, which require municipal defendants in custody to be seen within two (2) days of their arrest, an IGA was formed in 2018. The purpose of the IGA was to assist the cities of Brighton, Commerce City, Northglenn, Thornton and Westminster to utilize a specified room at the Adams County Detention Facility for video court services to conduct hearings with defendants that were in custody. The fee assessed is determined based on the percentage of usage within a calendar year.

Per the request of the Adams County Detention Facility, the IGA will be modified to include the municipalities of Aurora and Federal Heights.

There will be no cost to the City for 2021. The cost to the City for each subsequent year will be $5612.20. If demand is higher, this fee may increase in the following years. The fees will be analyzed annually by May 1st based up the usage analysis between all parties for the service.

Chief of Police Southard has stated that this is more cost effective than having to transport the defendants and maintain the safety of not only the defendant but also the
Court staff and the public.

Attached is a copy of the proposed Resolution and Intergovernmental Agreement adopting the IGA.
