PURPOSE
Consider a resolution to find and acknowledge that good cause exists and that it is in the best interest of the City to waive the request for proposal process for procurement of legal and engineering services for water rights procurement and protection including more specifically contract renewals with Fischer, Brown, Bartlett, and Gunn; White Sands Water Engineers; and Leonard Rice Engineers through December 31, 2015.
BACKGROUND
1. The City has utilized the services of the engineers and attorneys working for Fischer, Brown, Bartlett, and Gunn; White Sands Water Engineers; and Leonard Rice Engineers through virtually its entire active existence in water court. This team is integrally familiar with Brighton's water rights and the history with neighboring communities.
2. The three companies have good working relationships with each other, the City of Brighton staff, and many opposers the City works with regularly. They are effective at forming a united front in procuring and protecting the City's resources.
3. Fischer, Brown, Bartlett, and Gunn is the City's special water counsel.
4. White Sands Water Engineers provides surface water analysis and expertise.
5. Leonard Rice Engineers provide groundwater analysis and expertise.
6. Staff has reviewed the associated agreements and has no additional comments.
