PURPOSE

Requesting City Council approval of and authorization for the City Manager to execute a Lease Agreement between the City of Brighton and T-Mobile West, LLC for a cell equipment site and associated cell antennas located at the City’s South Storage water tank site.

BACKGROUND / DISCUSSION

The City of Brighton entered into the original lease agreement with Nextel in December of 2006. The lease allowed for the installation of cell antennas on the 0.5 MG water tank and a ground equipment area of approximately 1,500 square-feet. The City approved the installation of additional equipment on the 0.5 MG water tank in 2015, which did not include additional ground space. The original lease agreement terminated in December of 2021, and Tenant continued to rent the space on a month-to-month basis under the terms of the original agreement.

The City and Tenant have negotiated the proposed lease agreement with new terms and conditions, including an increase in monthly rent, terms related to responsibilities during times of water tank maintenance, and payment for utilities (i.e. electricity) that service the site.
