Through:                                          Michael Martinez, City Manager

Prepared By:                                          Alicia Calderón, City Attorney

Date Prepared:                     July 12, 2022

PURPOSE

To provide a report on the activities of the City Attorney’s Office and to recess into an executive session to discuss pending litigation, receive legal advice, and to conduct the annual City Attorney performance evaluation.

BACKGROUND

The City Attorney is appointed by the City Council and the Municipal Charter sets out the duties of the City Attorney. Much of what attorneys do is protected by the attorney-client privilege and other confidentiality laws. However, the goal of this report is to share with City Council and the public aggregate data reflecting the work performed by the City Attorney’s Office. After the public presentation, the City Attorney will request a motion to recess into an executive session for the purpose of reviewing pending litigation, to provide direction for negotiations upcoming in pending litigation, and to conduct the annual performance evaluation of the City Attorney.

EXECUTIVE SESSION

1)                     Motion to adjourn to executive session pursuant to C.R.S. § 24-6-402(4)(b), (e), and (f) for a conference with the City Attorney for the purpose of receiving legal advice on specific legal questions related to ongoing litigation, to determine positions relative to matters that may be subject to negotiations, and for personnel matters.
