PURPOSE
Requesting City Council's approval for the procurement of 23-008335 Baseline Road Weir Outfall Replacement by awarding a contract to American West Construction, LLC, deemed the most responsive and responsible bidder of the seven (7) bids received in response to the published solicitation, and approving the resolution giving the City Manager, or designee, authority to sign the contract. Per City Code Section 3-8-30(b): "All materials, services, and construction contracts, except as otherwise provided in this Article, with an estimated cost greater than one hundred thousand dollars ($100,000.00), shall be awarded through the formal solicitation procedure or the formal RFP process by the City Council. After due notice inviting bids, purchase orders and contracts shall be awarded to the lowest, responsive and responsible bidder."

BACKGROUND
There is an existing, substandard weir measurement structure in the outfall ditch just north of Baseline Road. The structure is used for measuring the amount of raw augmentation water the City returns to the South Platte River as required by Water Court decrees. Data is gathered from the measurement device and communicated through SCADA. This ditch also conveys stormwater runoff from the northern portion of the City, which can occur simultaneously as augmentation water flow. In order to get accurate water augmentation accounting for the State Engineer's Office, the weir must be able to measure high and low flows, which cannot currently be done with accuracy.

The City previously hired a consultant, Applegate Group, Inc., to design the new structure and assist with floodplain impact analyses.
