PURPOSE
To conduct an attorney-client privileged communication in executive session involving pending, possible, and concluded litigation and claims involving the City. 

 

BACKGROUND

The City Attorney’s Office monitors and works with outside counsel on all litigation and notices of claim received by the City. This year the City Attorney’s Office has also represented the City directly in litigation. Approximately twice a year, the City Attorney provides an update on claims and litigation to City Council. Additionally, when considering possible litigation with the City as plaintiff, the City Attorney presents these to City Council prior to filing any action.

 

OPTIONS FOR COUNCIL CONSIDERATION

City Council may make a motion, with the affirmative vote of two-thirds of the quorum present, to recess for an executive session pursuant to Colorado Revised Statute Section 24-6-402(4)(b) and Charter Section 5.4(C)(3) for matters of attorney-client privilege and to receive legal advice.
