City Attorney’s Office
Reference: Updates to the Municipal Code Regarding Boards and Commissions
To: Mayor Gregory Mills and Members of City Council
Through: Michael P. Martinez, City Manager
Prepared By: Alicia Calderón, City Attorney
Date Prepared: March 6, 2023
PURPOSE
To approve an ordinance amending and updating certain sections of the municipal code regarding boards and commissions.
BACKGROUND
Last year, in a study session, the City Council reviewed all boards and commissions to which council members are appointed. As a part of the discussion at the July 26, 2022 meeting, the City Council heard the recommendation that City Council members not be voting members of advisory City boards and commissions. Since last July, the City Attorney’s Office has reviewed Article 2 and found other updates are needed. For example, the Board of Appeals has not had any members in some time. The Parks and Recreation Advisory Board had specific appointments that were too difficult to fill, so removing those restrictions will allow more interested persons to serve. Lastly, a reference to City boards and commissions being limited to those identified in state statutes has been removed. The City of Brighton is a home rule municipality and is not bound to the limitations of statutory cities.
