PURPOSE

To consider an ordinance approving the sale of real property to Richard and Rochelle Coufal.

BACKGROUND

The City received a parcel of property in Weld County primarily for the water rights as part of a water dedication for development. The parcel is currently vacant land. The City plans to eventually construct an infiltration pond on the property in order to meet return flow obligations for the ditch system water rights the City owns. The five acres parcel being purchased is separated from the larger parcel by the irrigation ditch, and the City has no plans for use of this parcel.
The family farmed a 137-acre property, and upon the parents' deaths, the property was divided into two parcels. Richard Coufal and his sister inherited the east parcel, and his two brothers inherited the west parcel. The west parcel was purchased by a developer from the two brothers and then dedicated to the City for development obligations related to water dedication.
Richard and Rochelle Coufal approached the City about acquiring approximately five acres adjacent to their land for dry land farming. Richard Coufal's father farmed the land beginning in 1973, and Richard and Rochelle Coufal would like to add these five acres that are adjacent to their property to continue to put the land to beneficial use. This parcel is east of the irrigation ditch that divides the property and adjacent to the Coufal property.
The City has no plans to use these five acres and supports the purchase and sale of the property for $31,500 dollars. This property has no improvements and no associated water rights.
FINANCIAL IMPACT

The sale of the property will benefit the City, and the City has no associated costs with the closing.
