PURPOSE
Requesting City Council's approval for the procurement of Engineering Services During Construction by accepting a waiver of solicitation thereby awarding a contract to Brown & Caldwell, and approving the resolution giving the City Manager, or designee, authority to sign the contract. Per City Code Section 3-8-60, "...The City Council may waive the formal solicitation procedure for contracts greater than one hundred thousand dollars ($100,000.00). However, any such waiver shall be implemented only if there is first a determination by the City Manager or the City Council, as applicable, that such waiver will be in the best interest of the City."
BACKGROUND
The City entered into a contract with Brown and Caldwell in 2019 for a conceptual engineering design for a water treatment plant expansion at the existing facility and denitrification processes. Denitrification was needed to ensure the City could meet Colorado Department of Public Health and Environment (CDPHE) discharge restrictions placed on the brine discharge from the reverse osmosis (RO) plant. In 2021, the City amended the contract to reflect the design of a new water treatment plant and include design services at the City's wastewater treatment plant (WWTP). The intent was for the City's WWTP to treat the RO brine in order to meet the regulations of the CDPHE. In 2022, the contract was again amended to reflect the final design of the currently-scoped water treatment plant. This current scope of services includes the design of a 20 million gallon per day (MGD) WTP, biological denitrification processes, and water softening processes.
