PURPOSE
Requesting City Council approval of transferring of small tracts of Park/Open Space to the Brighton Crossing Operations Board (BCOB)

BACKGROUND

During the 1990’s-2000’s, Brighton Crossing Operations Board dedicated eight (8) small tracts of land to the City of Brighton.  The average acreage of seven (7) of the tracts is less than 2 acres and one tract is 3.6 acres.  Over the years, the Brighton Crossing Operations Board (BCOB) developed these small tracts into pocket parks and neighborhood connections and the BCOB has maintained and operated these tracts.  The City has had no involvement with the tracts maintenance or operations.  The new Development Code approved by the City Council in 2019 states the City will not take maintenance responsibility for any tract of land less than 5 acres in size and by transferring these tracts we will also meet the intent of the new Development Code.

 

FINANCIAL IMPACT

Transferring ownership of the eight tracts to BCOB will clarify who is responsible for the maintenance and liability for these tracts and will be consistent with the standards of the recently adopted Land Development Code.  The City of Brighton Parks & Open Space Department will not have any maintenance or operational responsibilities in these eight (8) tracts.

 

STAFF RECOMMENDATION

City staff recommends the City of Brighton transfer ownership of these tracts to Brighton Crossing Operations Board.
