PURPOSE
Consider a resolution authorizing the renewal of a Professional Services Agreement with Fischer, Brown, Bartlett, and Gunn, P.C. (FBBG) for a term ending December 31, 2015 to represent the City of Brighton as special water counsel for the City of Brighton, particularly as it relates to water rights procurement and protection.
BACKGROUND

1. FBBG has served as special water counsel to the City since 1985. In that time they have developed an in-depth understanding of the City's water supplies, systems, existing decrees, and on-going water court cases. The company's Brighton-specific experience and knowledge base allows them to give superior service in the many on-going court cases and agreements the City is involved in.
2. FBBG provides quality services at a competitive hourly rate.
3. FBBG is retained on an as-needed basis. Their time is closely monitored by staff and is limited by the Council-approved operating budget.
4. Staff has reviewed the contract and has no additional comments.

CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEM
FINANCIAL IMPACT
This contract is paid for out of the 2015 operating budget approved by Council in late 2014. No additional funds are requested at this time. Charges are accrued on an as-needed basis as specifically requested by City staff.
STAFF RECOMMENDATION
Based on FBBG's quality service, competitive pricing, and tenure with the City, staff recommends the approval of the resolution authorizing the renewal of the Professional Services Agreement with Fischer, Brown, Bartlett, and Gunn, P.C.
