Reference: Amend Municipal Code Regarding Access to Public Records in Specified Digital Formats

PURPOSE
To amend the Municipal Code to implement SB 17-040 which provides for the health, safety and welfare of the people.
BACKGROUND
SB 17-040 was signed by the Governor and was effective August 9, 2017. SB 17-040 requires that the custodian of a record provide to the requestor the documents in the digital format as it is stored. The Municipal Code will be amended as follows:
Sec. 1-27-30(h) Rules and Regulations
Data and/or records will be provided only in the format they currently exist as provided in C.R.S. §24-72-203(3.5). If the record is stored in a digital format that is neither searchable nor sortable, the custodian shall provide a copy of the record in a digital format. If the record is stored in a digital format that is searchable but not sortable, the custodian shall provide a copy of the record in a searchable format. If the record is stored in a digital format that is sortable, the custodian shall provide a copy of the record in a sortable format.
STAFF RECOMMENDATION
Staff recommends approval of the Ordinance amending the Municipal Code to be compliant with SB 17-040.
