PURPOSE
To establish an Intergovernmental Agreement with the Adams County Sheriff's Office and the Cities of Commerce City, Northglenn, Thornton and Westminster for a system to safely and promptly have defendants that are in custody appear before the respective jurisdictions Judge as required by law.

BACKGROUND
House Bills 17-1338 and 16-1309 require municipal defendants in custody be seen within two (2) days, and such appearances must be with an attorney. In order to accommodate the request of all ADCO municipalities and the increased demand on ADCO courts, an additional room had to be created to meet the demands. ADCO also allocated staff and equipment to fulfill this obligation on their end. Each municipality will assign a staff member responsible for handling municipal court video support. Michelle Ramos, Court Administrator, is Brighton's designated staff member.

The cost to the City for 2019 is $8,000. If demand is higher, this fee may increase in the following years. The fees will be analyzed annually by May 1st based up the usage analysis between all parties for the service.

Chief of Police Southard has stated that this is more cost effective than having to transport the defendants and maintain the safety of not only the defendant but the
Court staff and the public.

Attached is a copy of the proposed Resolution and Intergovernmental Agreement adopting the IGA.

FINANCIAL IMPACT
The total benefits package for 2019 is $8,000. Each year, no later than May 1st, ADCO will provide an annual usage of fees for each municipality for each jurisdiction for the following year.
