PURPOSE

An Ordinance of the City Council of the City of Brighton, Colorado, approving a Lot Line Agreement by and between the City of Brighton and Barry K. Ohlemeier, and Authorizing and Directing the City Manager to Execute said Agreement

BACKGROUND
The City Code requires that the disposal of City owned land must be approved by the City Council through an Ordinance.

The City of Brighton acquired the Fairview Cemetery in 2000 from the Fairview Cemetery Association. Sometime prior to the City ownership there were burials interned that were not on Cemetery land. The burials occurred in the Northeast corner of the Cemetery on Mr. Ohlemeier's Property. To accommodate the neighbor to the east of Fairview Cemetery, Mr. Ohlemeier, staff has been requested to construct a fence to separate the cemetery land from Mr. Ohlemeier property. To complete the fence all the burials must be on cemetery property.

The Lot-Line adjustment will have the City deed to Mr. Ohlemeier 1,383 Square Feet of land. Mr. Ohlemeier will deed to the City 2,122 square feet of land. The City will receive an additional 739 square feet of land as a result of the lot-line adjustment. The City will compensate Mr. Ohlemeier $1,012.43 for the additional land the City will receive.

FINANCIAL IMPACT

The funds for the payment to Mr. Ohlemeier and the construction of the fence are in the 2019 Capital Improvement Fund
