PURPOSE

To add Section 2-4-14 to the Brighton Municipal Code regarding a complaint process for Fair Campaign Practice Act (FCPA) violations.

BACKGROUND

All municipal candidates that receive contributions or make expenditures are required to file reports with the municipal clerk. The candidate is responsible for becoming familiar with the FCPA provisions in Article 45 of Title 1 of the Colorado Revised Statutes. The Colorado Secretary of State will not accept complaints regarding municipal elections, these must be filed exclusively with the municipal clerk as required in C.R.S §1-45-111(9) (b).

 

The City of Brighton does not have a procedure for accepting and addressing complaints alleging violations of the FCPA. This Ordinance will provide a consistent, clear and fair process for receiving and investigating FCPA complaints in municipal elections and provide due process for enforcement of the FCPA requirements.
