PURPOSE

Utilities is requesting City Council's consideration for the approval of two intergovernmental agreements (IGAs): 1) South Adams Water and Sanitation District ("South Adams") and the City and 2) Denver Water, South Adams, and the City. Staff is requesting approval of a resolution to approve the second IGA.

BACKGROUND

The City of Brighton is planning to purchase water from Denver Water and transport it through the South Adams' distribution system over the next 5 years to assist with peak summer demand. The City will be purchasing 139 acre feet (AF) annually of water during the summer irrigation season from June to August. This IGA addresses the amount to be purchased and the costs for the water and for the transport. In order to transport the water, the City needs to finish connections with the South Adams system.

The second IGA with South Adams addresses and replaces previous IGAs between South Adams and the City of Brighton from 1997 and 2010 for utility service to areas in the southern part of Brighton or Brighton's growth area. As contemplated in those previous agreements, the City will extend its system and serve those customers. The City is currently constructing a water main in Peoria Street that will allow the City to provide service to the limited number of homes that are currently served by South Adams at Fuller Estates, except two properties. Upon connection, South Adams will convey its laterals in 114th Avenue, and eventually 112th, to the City. By December 31, 2025, the City will build a 12 inch water main within 112th Avenue, which will then provide a looped infrastructure to the entirety of Fuller Estates and allow service to the entirety of Fulle...
