City Attorney’s Office
Reference: Brighton Crossing Metropolitan District Nos. 5-8 Boards of Directors
To: Mayor Gregory Mills and Members of City Council
Through: Michael Martinez, City Manager
Prepared By: Alicia Calderón, City Attorney
Date Prepared: August 3, 2022
PURPOSE
The City Council may reconstitute the Boards of Directors for the Brighton Crossing Metropolitan Districts Nos. 5-8 (collectively, the “Districts”) if there are no duly elected directors and if the failure to appoint a new board will result in the interruption of services being provided by the district. The Districts petition the City Council to approve a resolution appointing members to the boards of directors of the Districts.
STRATEGIC FOCUS AREA
Recognizable and Well-Planned Community
Strong Regional Relationships and Partnerships
BACKGROUND
The attorneys for Districts realized the elected board members did not complete the directors’ oaths of office following the May 3, 2022 election by the deadline set forth in state statute. This resulted in there being no board members at all. The state statutes do allow for the local governing body to appoint all the board of director members. This resolution appoints qualified, willing and eligible electors to each Board. Within six months after the Boards are reconstituted, an election is required to elect any interested candidates or to re-elect the directors who are being appointed by the City Council.
STAFF RECOMMENDATION
Approval of the resolution is recommended in order to avoid an interruption of services for the metropolitan districts.
