PURPOSE
The Grant of Easement document (“Easement”) before City Council is for the purpose of granting a perpetual easement to Public Service Company of Colorado (“Xcel”) to install and maintain utility lines to the Municipal Service Center (“MSC”).

 

BACKGROUND

The City is actively constricting the MSC, generally located on the north side of Denver Street adjacent to N. Main Street.  Xcel was provided the project information and then proceeded to design the location, including obtaining easements, to perform the installation of the new utility lines through boring and excavation operations to place the infrastructure.  

 

CRITERIA BY WHICH COUNCIL MUST CONSIDER THE ITEM

When reviewing easements, the City Council should consider whether the granting of the Easement will not prejudice the best interest of the City.

 

FINANCIAL IMPACT

None.

 

STAFF RECOMMENDATION

City staff finds that the Easement does not prejudice the best interest of the City, and therefore recommends approval of the Easement by City Council.  The Easement agreement has been reviewed and approved by the City Attorney’s Office.

 

OPTIONS FOR COUNCIL CONSIDERATION

The City Council has three options when reviewing the Ordinance to Grant and Easement.  City Council may:

1.)                     Approve the Ordinance granting the Easement;

2.)                     Deny approval of the Ordinance; or

3.)                     Continue the item to be heard at a later, specified date if the Council feels it needs additional information.
