PURPOSE
Requesting City Council approval of change order #1 to Contract 23-008327, North 10th Avenue & Midland Street Storm Improvements, and approving the Resolution giving the City Manager, or designee, authority to sign the change order. Per City Code Section 3-8-170, "All change orders or amendments shall be processed through the office of the Procurement Manager. Department directors shall have authority to approve individual amendments or change orders up to the department director's aggregate signing authority for the total contract price. The City Manager shall be authorized to execute amendments or changes orders, in the aggregate, up to ten percent (10%) of the original contract amount. All other amendments or changes orders shall be approved by the City Council, as appropriate, based on the signing authority established in this Article."

BACKGROUND
City Council authorized execution of contract 23-008327 on December 5, 2023, in the amount of $358,835.01. The contract is between the City of Brighton and American West Construction, LLC.

American West Construction was authorized by City staff to utilize a portion of the nearby park parking lot for construction material storage and staging. The parking lot surface was in poor condition due to drainage issues and existing cracking/deterioration. Due to the construction activity, the parking lot surface was damaged further.

It was determined to be in the best interest of the City and residents to replace the entirety of the parking lot surface, not just the damaged portion. American West Construction, Brighton Parks and Recreation and Brighton Utilities will all contribute to re-pave and repair the entirety of the parking lot surf...
